殺男友伴屍3日 判刑9年半

（中央社記者蔡沛琪台北24日電）呂姓女子去年與同居男友酒後爆發口角，砸安全帽並砍死男友，事後伴屍3天。最高法院減刑後，今天依殺人罪判刑9年半確定。

法院判決指出，呂女有多項竊盜前科，她出獄後在民國101年12月結識資源回收業者王姓男子，兩人交往後同居在嘉義縣六腳鄉。

隔年2月，兩人在房內喝酒，酒後發生口角相互拉扯扭打，呂女掐住被害人脖子並壓倒在地，不顧被害人哀求，拿安全帽猛擊，還拿菜刀砍殺，結果被害人失血慘死。

呂女後來用被單蓋住被害人屍體，再開電風扇吹，伴屍同住3天，警方後來據報前往查看，詢線逮捕呂女。她到案後辯稱，平時常遭被害人責罵，她忍不住一時衝動而下手。

最高法院審理後認為，呂女只因細故與被害人爭吵，竟持安全帽、菜刀殺人，對生命尊嚴顯然輕忽，嚴重影響社會治安，惡性非輕；考量她犯案所受刺激、智能障礙及仍有子女待養等情事，因此輕刑，依殺人罪判處9年6月徒刑，全案定讞。1030324
