本來同為生理男性的吳伊婷、吳芷儀，因為在變性為女性後被內政部撤銷婚姻關係，內政部在受到抗議與新聞報導後決定於7日開會討論，經3個半小時後終於同意認定婚姻有效，保住兩人結婚關係。雖然這並非代表同性婚姻合法化，但當事人希望，自己的案例可提供政府更多性別詮釋的空間。
原來都是生理男性的吳伊婷、吳芷儀在接受俗稱變性的性別重置手術後，在台北市萬華戶政事務所登記結婚，當時吳伊婷已於戶政單位完成變更性別為女性，兩人結婚當下的身分證性別是一男一女；另一名身分證性別還是男性的當事人吳芷儀，也在登記結婚後也提出申請變更為女性，卻被戶政單位認為婚姻效力有疑義而提請解釋。
內政部認為，兩人在登記結婚當時已為女性，民法規定結婚當事人應為一男一女，因此撤銷兩人的婚姻關係，但因為登記當時兩人身分證資料確為一男一女，且內政部僅以公函行政解釋的方式，就要求撤銷結婚登記，被質疑於法無據，因此當事人找上立委鄭麗君、尤美女陳情。
民進黨立委鄭麗君與尤美女質疑，兩位陳情人在登記結婚當下完全是合法的，登記即為有效，內政部不尊重當事人結婚時的法律事實，而主觀認定兩位當事人在結婚當時是同為女性，就撤銷婚姻關係的作法，恐有侵害婚姻保障之嫌。
為此，內政部在7日下午2時邀請民間團體代表、專家學者、相關機關、各直轄市、縣(市)政府召開研商性別與結婚登記相關事宜會議。
